Birthday Rule
The New Jersey Department of Insurance regulations require the use of the Birthday rule in New Jersey insurance contracts. However, that rule does not apply to contracts issued out of state. Self-funded plans are not governed by the regulation. Consequently, there are times when a dependent child is covered by two plans, one using the Birthday rule and the other using the Gender rule. The plan that utilizes the Gender rule will be primary to a plan that follows the Birthday rule. According to the Birthday rule the parent whose birthday (month and day) is first in the year is primary for the dependent children.
