Here's a brief summary on the status of current Health Insurance Portability and Accountability Act (HIPAA) rules and deadlines.
Security Rules. On Feb. 20, 2003, HHS issued final rules implementing security requirements to safeguard protected health information. The rules become enforceable on April 21, 2005.
Transaction and Code Set Rules. The transaction and code set standards became enforceable on Oct. 16, 2003. Although many providers remain noncompliant, HHS is following a "good faith" enforcement approach.
Privacy Rules. The final rules for protected health information became enforceable on April 14, 2003. Federal courts have dismissed several legal challenges to the rules. One lawsuit filed by privacy advocacy groups remains pending in a federal court in Pennsylvania.
